Agency Terms and POPIA operator agreement

This is a DRAFT placeholder, pending legal review. It describes how Connect Forge treats agencies today. It is not the final agreement, and the version will change when the reviewed text replaces it; you will then be asked to accept again before your agency can act.

1. What an agency is on Connect Forge

An agency manages Forge apps on behalf of its own clients. App Forge approves every agency before it can do anything; until then an application has no powers.

An agency registers only NEW client businesses, for clients who have given it a written mandate to do so. It never takes over a business that already exists on Connect Forge. An existing business is linked to an agency only by App Forge, with the business owner’s agreement and a notice to them.

Agency staff open a client’s apps as themselves. They never receive the client owner’s login.

2. Your clients stay in control

The client’s owner is emailed when an agency registers or is linked to their business. On Connect Forge they can see which of your staff opened which app for them in the last 30 days, and they can end your access with one click, at any time.

Access ends in the apps as well as on Connect Forge: when a client revokes you, when you remove a staff member, when App Forge suspends the agency, or when a staff member has not opened that client in that app for 30 days.

3. POPIA — you are an operator for your clients

For the personal information in your clients’ apps, your client is the responsible party and your agency processes it as an operator: only on the client’s instructions, only for the work the client asked for, and with the confidentiality and security measures the Protection of Personal Information Act 4 of 2013 requires of an operator.

Every staff member you invite acknowledges this when they join, and agrees that their email address and the apps they open are shown to the clients whose information they open.

Tell App Forge and the client without delay if you suspect personal information was accessed or acquired by someone not authorised to do so.

4. Limits

An agency starts with a limit of 10 clients and may register at most 5 new clients in 24 hours. App Forge may change the limit.

Each client pays for its own app plans. Agency staff may pay a client’s plan through that client’s own checkout.

App Forge may suspend an agency at any time; suspension ends every seat the agency holds in its clients’ apps.
